The Commercial Name in Decision 486: A Registration or a Declarative Deposit?

Intellectual Property attorney José Daniel Suárez wrote an article for Legal Industry Reviews (LIR) analyzing a decision from the Andean Community that pertains to the regulation of commercial names. Mr. Suárez explains that a commercial name is a distinctive sign that is used to identify the economic activities of a business owner, business or mercantile establishment. Through Decision 486, the Commission of the Andean Community allowed its member countries (Bolivia, Colombia, Ecuador and Peru) to opt to follow a process of registration, or deposit, before each national office with respect to commercial names. In this article, the author examines the implications of this decision, in particular for Colombian companies.
