The State of State of Mind Testimony by Experts

Litigation attorney Eric Alexander authored an article in Drug & Device Law about expert testimonies related to state of mind and the implications for product liability cases. With help from fellow Holland & Knight litigation attorney Kelly McNeill, the article presents a brief history of multidistrict litigation (MDL) related to the exclusion of expert opinion on the state of mind of corporate defendants. Mr. Alexander later analyzes the issue of admissibility of expert testimony in a case currently pending before the U.S. Supreme Court, Diaz v. United States, and its implications for product liability cases in the future.
