Florida Enacts the First Significant Reforms to Agency Rulemaking and Other Processes in Years
Administrative law attorneys Tiffany Roddenberry and Larry Sellers co-authored an article for The Florida Bar Administrative Law Section Newsletter summarizing reforms to Florida agency rulemaking and administrative processes. Gov. Ron DeSantis signed Senate Bill (SB) 108 into law in June 2025, and it took effect on July 1, 2025, ushering in some of the most expansive changes to state agency rulemaking procedures in years. The legislation amends deadlines to publish notices of rule development, adds to the list of information that must be included in notices of intended action for proposed rules, requires all agencies to review existing rules to determine whether they represent a valid exercise of delegated legislative authority, prohibits sunset provisions or related automatic expiration stipulations in rules and clarifies steps to take for emergency rules.
