Understanding New York's Proposed Data Centre Moratorium
Energy attorneys Graham Coates, Brendan Connors and Nic Martell published an article in Data Center Network News on New York Senate Bill 9144, which proposes halting large-scale data center development while the state reassesses environmental and utility rate impacts. They explain that the bill would pause permits for data centers capable of using 20 megawatts or more of electricity until state agencies finalize a new generical environmental impact statement (GEIS) and other processes to assess the utility, energy consumption, water usage and other effects of data center operations. The article describes how the proposal could reshape project schedules, site control, interconnection planning and power procurement, while also creating pressure for operators to absorb the full cost of new energy infrastructure. The authors additionally highlight practical considerations for developers, including creating capital deployment plans, considering phased designs or alternative jurisdictions, and engaging early with regulators, utilities and local officials to help protect projects as oversight of the sector grows.
