Electronic Service: Notifying Foreign Companies
Litigation attorney Jonathan Sanchez authored an article for Lexir on the importance of electronic service of process for foreign companies with commercial or employment ties to Colombia. Although Law 2213 of 2022 authorized electronic service, courts have applied Article 8 differently when a foreign company has no domicile or branch in Colombia. Mr. Sanchez notes, however, that recent decisions by the country's Constitutional Court and Civil Chamber of the Supreme Court of Justice have upheld direct electronic notice to defendants abroad. He also highlights that Law 2452 of 2025 reinforces electronic notification in labor cases and increases exposure for foreign employers with Colombian workers. He concludes by advising foreign companies to monitor official communication channels and respond quickly to judicial notices.
