A Camera on Every Corner – And a Regulatory Gap

The Legal Intelligencer
Kristen N. Ricci | Ashley L. Shively

Data Strategy, Security & Privacy attorneys Kristen Ricci and Ashley Shively wrote a column for The Legal Intelligencer examining the growing use of automated license plate readers (ALPRs) on private property and the regulatory challenges that accompany their expansion. The authors explain that because existing ALPR laws largely focus on law enforcement use, significant gaps remain regarding private deployment and the technology providers that collect, store and aggregate vehicle location data. Kristen and Ashley describe how large-scale ALPR databases can create detailed records of individuals' movements and argue that effective regulation must address both the entities deploying the cameras and the providers controlling the underlying data. They also highlight emerging state approaches that strive to balance legitimate security and access management purposes with safeguards governing data collection, retention, sharing and security, suggesting that lawmakers will adopt broader oversight of the full ALPR data life cycle as private use continues to expand.
