FCA Bar Jittery as 'Game-Changing Case' Goes to Justices

False Claims Act Defense attorney Megan Mocho was quoted in a Law360 article discussing a case that could have a major impact on the False Claims Act (FCA). The U.S. Supreme Court will hear arguments on Tuesday, April 18, in a case that examines whether a defendant's subjective understanding of the lawfulness of their conduct is relevant to whether they knowingly violated the False Claims Act. Both sides have strong arguments and are expecting a ruling that could have a major impact on the FCA docket. Ms. Mocho commented that the outcome could be a nuanced opinion that allows for both sides to claim a measure of victory. 

"I do think that there's going to be both give and take in the decision," she said.
