NY Seeks Comment on Proposed Cyber Regulation Amendment
Cybersecurity and data privacy attorney Mark Francis was quoted in a Business Insurance article about a proposed amendment to New York's cyber regulation. The New York State Department of Financial Services issued an amendment in November 2022 and a revised proposal in June, with the expectation of finalizing the regulation at the end of the year. The latest changes would create a set of three tiers of companies as well as enhanced governance requirements and controls to prevent unauthorized access to systems. Mr. Francis commented that the November 2022 and June 2023 proposals do not differ dramatically.
The newest version "clarifies or tweaks the earlier proposal and indicates that the agency was receptive to some of the feedback it received," he explained.
