Bill Would Give Governors Power to Question CFIUS About Transactions
CFIUS and Industrial Security attorney Antonia Tzinova was quoted in a Foreign Investment Watch article about proposed legislation that would require the Committee on Foreign Investment in the United States (CFIUS) to respond to inquiries from governors regarding potential transactions in their states. The article explains how the confidentiality of CFIUS deliberations conflicts with mandating such disclosures. Ms. Tzinova and other professionals noted that these information requests could overwhelm CFIUS given its complex review process. She also commented that the bill could be impractical to implement because it would impose a communication burden on the committee.
Specifically, Ms. Tzinova said that a mandated CFIUS response to a governor's request would "necessitate establishing some procedure on minimally needed information and will definitely take away time and resources from CFIUS' current review work."
