NY Landlords Map Muddled Path to High Court Rent Battle

Real Estate attorney Alexander Lycoyannis was quoted in a Law360 article about the ongoing efforts by New York landlords to challenge the state's rent stabilization laws at the U.S. Supreme Court. Despite repeated denials of certiorari in previous cases, landlords are now attempting to align their petitions with criteria suggested by Justice Clarence Thomas. Mr. Lycoyannis commented on the difficulty of predicting the Supreme Court's actions but noted recent rulings indicate it could address these issues, if given the right opportunity.

"I believe that this is something that, were it to get to the Supreme Court, I think would stand a pretty good chance of being overturned. The problem is getting over that initial hurdle of getting the Supreme Court to grant certiorari," he said.
