USA: Protecting Americans' Data from Foreign Adversaries Act Enters into Force - Impact on Businesses

Cybersecurity attorney Mark Francis spoke with OneTrust DataGuidance about the Protecting Americans' Data from Foreign Adversaries Act of 2024, which prohibits data brokers from selling or transferring sensitive personal data of U.S. individuals to foreign adversary countries or entities controlled by them. Mr. Francis noted that the act's broad definitions of "data broker" and "sensitive data" will likely result in compliance burdens for a wide range of organizations beyond traditional data brokers. He advised businesses to assess their current data flows, incorporate the new prohibitions into their privacy and cybersecurity programs, and potentially make difficult decisions on data activities that may fall within the scope of the new law.
"This Act doubles down on restrictions intended to prevent the dissemination of sensitive personal information about U.S. residents to foreign adversaries, with broad bipartisan support," he said.
