Judge Clarifies Scope of DBE Injunction to Include More States

State and Local Government Procurement Team Leader Keith Wiener was quoted in a Construction Dive article a federal judge's clarification on the scope of an injunction against the U.S. Department of Transportation's (DOT) Disadvantaged Business Enterprise (DBE) program. The article discussed how the injunction, which prohibits the DOT from using gender- or race-based assumptions in its DBE program for certain contracts, could apply in at least 23 states and possibly nationwide. Mr. Wiener provided insights on the ruling's implications and its potential to influence future legal challenges.
"The decision is significant also because other Plaintiffs may attempt to use this court's order on September 23, 2024, and this October 31, 2024, order to obtain similar injunctions throughout the U.S. against the enforcement of the federal DBE Program," he said.
