Partner Megan Mocho Comments on DOJ FCA Enforcement Strategy
White Collar Defense and Investigations Team Co-Chair Megan Mocho was quoted in a Law360 article discussing the U.S. Department of Justice's (DOJ) new Civil Rights Fraud Initiative and its use of the False Claims Act (FCA) to pursue alleged violations tied to diversity and civil rights programs. Ms. Mocho explained that DOJ initiatives like this one often result in a surge of cases, both whistleblower-driven and agency-referred, and said she expects to see an uptick in FCA litigation based on previous examples such as the department's cyber fraud enforcement efforts. As a result, organizations will need to implement robust compliance protocols to respond to heightened scrutiny.
"You're starting to see the results of that initiative where there is now a significant number of cases. And so I would anticipate that, similar to other initiatives under the False Claims Act, this too will follow suit, and you will see a rise in cases making these types of allegations," she said.
