Trump's Use of Emergency Law to Enact Tariffs Imperils Trade War Strategy

International Trade attorney Patrick Childress was quoted in a Washington Post article discussing recent court decisions that have challenged President Donald Trump's strategy of imposing tariffs to reshape global trade, generate new tax revenue and benefit domestic manufacturers. Although the administration secured a temporary victory when a federal appeals court stayed implementation of one ruling, the White House continues to face multiple legal battles. As the cases unfold, officials are considering alternative options for imposing import taxes if the current strategy is ultimately blocked. Trump's approach has been to leverage the 1977 International Emergency Economic Powers Act (IEEPA), which offers the president broad authority to control economic activities during a declared national emergency. Mr. Childress noted that the IEEPA is attractive to the administration because it enables the president to swiftly implement and adjust tariffs.

"Part of the appeal of IEEPA to the administration is that it is a very fast process and it doesn't require long investigations or public input or the preparation of detailed reports. Instead, it's a very fast-moving process that allows the president to implement and change tariffs and tariff levels very quickly," he explained.
