MultiPlan Fails to Escape Reimbursement Collusion Litigation

Ken Racowski, co-head of the firm's Antitrust Team, was quoted in a Bloomberg Law article discussing the denial of MultiPlan Inc.'s motion to dismiss antitrust litigation alleging that the data analytics firm conspired with large insurers to suppress reimbursement rates using an algorithm. The court found the plaintiffs presented plausible evidence of parallel conduct and potential price-fixing violations, allowing the multidistrict litigation (MDL) to proceed. Mr. Racowski noted the continuing uncertainty in algorithmic price-fixing cases, expressing hope that appellate courts will provide clarity as cases move through the system.

"There is no sort of unified standard that seems to have emerged yet. We are still in that stage where we need some guidance from one of the circuit courts," he said.
