OBBBA Tax Exemption to Aid Florida Space Industry
Public Policy & Regulation and Aviation Law attorney Katie Inman and Project Finance attorney Edward Rojas were quoted in a Bond Buyer article about how Florida, home to one of the nation's most advanced space industries, stands to gain significantly from the newly enacted One Big Beautiful Bill Act. The law opens the door for alternate minimum tax-eligible (AMT) municipal bonds to fund cutting-edge spaceport infrastructure and space-related projects by enabling the use of AMT municipal bonds not only for constructing spaceports but also for supporting space-related manufacturing. With major industry players such as Blue Origin, SpaceX, Airbus, Amazon's Project Kuiper and CAE USA already operating at various locations in Florida, the state is well-positioned for further expansion.
Ms. Inman said, "The industry is truly taking off," and Mr. Rojas added the rules do not require public use of spaceports for them to be financed by AMT bonds, meaning that, for example, the bonds could be used to construct facilities for private companies' manufacturing of space launch vehicles.
