The Role of EPS in Complications Caused by Cosmetic Surgeries

Labor and employment attorney Diego Acevedo was interviewed by Asuntos Legales about the role of Health Promotion Entities (EPS) in addressing complications arising from cosmetic surgeries and the limits of coverage under Colombia's healthcare system. The article explained that although purely cosmetic procedures may be excluded, EPS must provide care when complications affect functional health or dignity or put life at risk, in light of precedents such as sentences T-579 of 2017, T-017 of 2008 and SU-239 of 2024. Mr. Acevedo noted the legal criteria that EPS often invoke to deny coverage and how judges have defined its scope in cases of malpractice and reconstructive needs.
"[EPS can refrain from offering patience coverage] if they are going to undergo cosmetic or luxury procedures that do not have the connotation of preserving some functional capacity or life," he said.
