Decision of the Council of State Leaves Other Key Measures of the Ministry of Health in Limbo

Healthcare attorney Diego Acevedo was quoted in El Espectador on the Colombian Council of State's provisional suspension of Decree 0858, noting that the ruling places recent health measures on uncertain legal footing and constrains the government's ability to advance a preventive care model. Mr. Acevedo explained that resolutions issued under the decree, such as the creation of functional regions, changes to Integral and Integrated Territorial Health Networks and criteria for EPS, could lack support unless anchored in other laws. He also highlighted that the suspension is a preliminary step pending a merits decision and outlined the limited scope for "transitory" acts during this period.

"[S]ince the provisional suspension is a precautionary measure, it is subject to appeals under the terms of the Code of Administrative Procedure and Administrative Litigation," he said.
