He explained that a Florida federal judge's ruling has intensified scrutiny of this long-standing enforcement mechanism that has returned tens of billions of dollars to the U.S. Department of the Treasury. He also noted that multiple federal circuits have rejected similar constitutional challenges, meaning an Eleventh Circuit decision affirming the Florida district court could create a circuit split and increase the odds of U.S. Supreme Court review.
