What Will Happen with Administrative Fees in Residential Complexes That Increased with the Minimum Wage?
Real Estate attorney Esteban García Jimeno was interviewed by Noticias Caracol about the effects of the suspension of the decree raising Colombia's minimum wage for 2026 on administrative fees in residential complexes. Colombia's Supreme Court issued its decision suspending said decree on February 13, 2026, also ordering the government to issue a temporary decree implementing a provisional increase while it debates the original one. Mr. García Jimeno clarified that the court's decision does not nullify or rescind the decree but rather suspend its effects. Regarding the administrative fees in residential developments, he added that in practice the outcome will depend on the temporary decree to be issued.
"The impact will depend on the effective date of the act to implement the increase: While Decree 1429 is legally in place, the raises based on the 23 percent [increase] remain valid," he explained. "If a new temporary decree takes effect with a different rate, that new parameter will apply for the foreseeable future."
