Where Can You Complain About the Management of Your Building or Complex Administrator?
Real Estate attorney Esteban García Jimeno was interviewed by Asuntos Legales about the mechanisms available to coowners to file complaints regarding the management of horizontal property administrators. He explained that Colombia's Law 675 of 2001 does not assign an external authority to comprehensively supervise administrators, meaning that oversight falls on the owners' board, board of administration and governmental authorities. He added that owners may move for an administrator's removal, request accountability or turn to the attorney general's office when there are indications of crimes related to the handling of resources.
"The law indicates that control over the administrator's management in horizontal property lies primarily with the internal bodies of the coownership," he clarified. "Depending on the circumstances of the case, crimes such as theft, breach of trust, disloyal administration, document forgery or private corruption could be involved."
