Warning to Residential Complex Administrators: What Can You Do If You Are Not Satisfied with Their Performance?

Real Estate attorney Esteban García Jimeno was interviewed by Blu Radio about the mechanisms available to condominium owners to challenge the management of property administrators in common-interest communities. He explained that in Colombia there is no single entity responsible for the general inspection, oversight and supervision of common-interest properties, so that function rests primarily with the internal governing bodies of the property. Mr. García added that the consequences for administrators will depend on how they were engaged and on the applicable contractual or employment framework, without prejudice to potential legal actions or complaints when irregularities arise.

"If it is a management company or an administrator retained under a services agreement, the penalties, sanctions or clauses set forth in the contract will apply," he said. "If the administrator has an employment contract, the rules and procedures of labor law must also be applied."
