Future Is Unpredictable for Prediction Markets as Courts Add to Confusion

Gaming and regulatory attorney Johnny ElHachem was interviewed by ESPN for a story examining the growing legal battle over prediction markets and whether sports event contracts fall under federal commodities jurisdiction or state gaming oversight. The article highlighted conflicting federal court rulings in Ohio and Tennessee, proposed legislation from Sens. Richard Blumenthal (D-Conn.) and Andy Kim (D-N.J.) allowing for state intervention and recent guidance from the Commodity Futures Trading Commission (CFTC) reinforcing the federal regulatory framework. Mr. ElHachem noted that the uncertainty reflects broader unresolved questions about how prediction markets should be regulated and said the likelihood of U.S. Supreme Court review will become more apparent as appellate rulings coming out.

The "open-ended questions" left by ambiguous laws in this area require "the judiciary to give the meaning and apply the spirit of the law. And that's why we see different rulings," he said. "Supreme Court involvement would become clearer once the appeals courts issue their decisions."
