Trump Administration Suggests Tariff Refunds May Take Significant Time

International Trade attorney Patrick Childress was cited in a New York Times article about the uncertainty surrounding refunds for importers that paid the now-invalidated tariffs imposed under the International Emergency Economic Powers Act (IEEPA). Even before the U.S. Supreme Court struck down the wide-sweeping measures, companies had filed lawsuits before the U.S. Court of International Trade to preserve refund rights before liquidation. Post-ruling, attention now turns to the Trump Administration to begin processing refund requests and determining how claims will be paid, a process it estimates could take 4 million hours. Mr. Childress added that businesses are awaiting instructions on the exact mechanics for refund recovery, such as a stipulation on whether they all need to sue individually or the Court of International Trade can order "refunds writ large to all importers."
