Trump Tariff 'Plan B' Begins with New Probe. What It Means for Importers.

International Trade attorney Andrew McAllister was cited in a Barron's article on the Trump Administration's new Section 301 investigations into several countries as part of its attempts to reestablish tariffs following the U.S. Supreme Court's decision invalidating measures imposed under the International Emergency Economic Powers Act (IEEPA). U.S. Trade Representative Jamieson Greer announced the new probe under Section 301 of the Trade Act of 1974 this week, saying it would analyze forced labor and "structural excess capacity and production in manufacturing sectors" in economies including China, the European Union, Mexico, Japan and India, but notably excluding Canada and the United Kingdom. Professionals interviewed by Barron's warned that Section 301 duties will affect sectors differently than the IEEPA measures, requiring a new round of analysis and calculation. Mr. McAllister also cautioned that any carveouts will likely be narrower than those granted by the first Trump Administration when it imposed Section 301 tariffs on China.
