4 Questions as Gov't Appeals Illegal Tariff Refund Suit

Litigation attorney Ashley Akers was quoted in a Law360 article analyzing the federal government's appeal of an order requiring immediate refunds for tariffs deemed unlawful by the U.S. Supreme Court under the International Emergency Economic Powers Act (IEEPA). The article examined questions surrounding the refund process, including whether the U.S. Customs and Border Protection's (CBP) consolidated administration and processing of entries (CAPE) system will continue, the likelihood of the government's success on appeal and implications for importers still awaiting relief. Ms. Akers commented on the practical and procedural uncertainty facing businesses, particularly those seeking refunds on finally liquidated entries, and advised companies to continue pursuing available avenues through CPB and the U.S. Court of International Trade to preserve their repayment rights.

"Much of those are catastrophic, for especially small businesses who are awaiting these refunds," she said. "There's still a large portion owed, and a lot of importers of record who are very antsy for their relief."
