Trump Administration Fights Court Order to Refund Some Tariffs
Litigation attorney Ashley Akers was cited in a New York Times article examining the Trump Administration's efforts to challenge a court order requiring refunds of tariffs unlawfully collected under the International Emergency Economic Powers Act (IEEPA). The article detailed the government's attempts to delay or limit repayment of the $166 billion in duties at issue, including requiring some importers to file individual lawsuits to recover the full amounts owed. Ms. Akers observed that the situation remains highly confusing for businesses that may now face additional litigation to secure complete repayment, even while refund processing for other claims continues.
"[That could result in] a flood into the federal court system," she said.
