What Can Happen If Your Employer Publishes Information About Your Mental Health?

Labor and Employment attorney Camilo Cuervo was interviewed by Asuntos Legales about the legal implications in Colombia that arise when an employer or another individual discloses information related to an employee's mental health. Camilo explained that information regarding a person's psychiatric condition is highly sensitive and is therefore protected under personal data protection regulations and the right to privacy. He also noted that the unauthorized disclosure of such information could result in administrative and disciplinary consequences, as well as violate constitutional rights such as that to a good reputation and medical record confidentiality. In such cases, he said, the affected individual could file a tutela action to request that the disclosure cease or be corrected.
