Small Businesses File Lawsuits Against Trump's New Sweeping Tariffs

International Trade attorney Patrick Childress was quoted in an Associated Press (AP) article about lawsuits challenging the Trump Administration's new Section 301 tariffs. Announced July 23, 2026, the levies on 60 trading partners provoked suits from small businesses including Learning Resources, one of the parties in the lawsuit against International Emergency Economic Powers Act (IEEPA) tariffs struck down by the U.S. Supreme Court in February. The plaintiffs here argue the government did not sufficiently establish a case against each specific economy targeted or adequately explain how the measures will eliminate the forced labor practices used to justify their imposition. Mr. Childress cautioned Section 301 tariffs have proven more resilient in court and will likely remain in place for the foreseeable future, even if countries implement the policy changes the administration requests.

"These tariffs will be with us for the long haul," he said. "...[N]o short-term path for country-wide relief from the new Section 301 tariffs will be available."
