Real Estate attorney David Thaxton was quoted in a Law360 article on the issues developers may encounter when pursuing data center projects in rural and unincorporated areas in Texas. David shared how building outside municipal zoning boundaries can eliminate some legal barriers while also shifting responsibility to developers for infrastructure, power generation and coordination with county officials. He also emphasized the importance of understanding local processes early, as road access, utility needs and county-level requirements can affect development schedules.

"Instead of having a well-defined process that you may have with a planning commission, you'll now have a patchwork of county requirements and state-level requirements, air quality permits and federal requirements, potentially, on environmental issues," he said.
