Overview

Cynthia G. Burnside concentrates her practice in the areas of class actions and commercial litigation, and she has extensive experience litigating complex cases for clients in the technology, financial, insurance and healthcare industries.

Ms. Burnside's experience includes representing clients with respect to claims arising under the Stored Communications Act (SCA), the Computer Fraud and Abuse Act (CFAA), the Telephone Consumer Protection Act (TCPA), the Securities Exchange Act of 1934, the Georgia Computer Systems Protection Act and the Racketeer Influenced and Corrupt Organizations Act (RICO).  She is well-versed in a variety of substantive legal areas, including, but not limited to, consumer disputes, statutory violations, intellectual property, trade secrets, restrictive covenants, securities fraud, breach of fiduciary duty and business divorce.

Ms. Burnside also has experience litigating and counseling clients on employment matters involving claims arising under Titles II and VII, Sections 1981, 1983, 1985 and 1986, Fair Labor Standards Act, Americans with Disabilities Act, Age Discrimination in Employment Act, Equal Pay Act and Family Medical Leave Act.

Experience

  • Represented bank holding company and officer in securities class action, successfully obtaining dismissal on claims arising pursuant to sections 10(b) and 20(a) of the Securities Exchange Act of 1934
  • Represented healthcare retail chain in class actions alleging violation of statute related to provision of copies of healthcare records dismissed for lack of standing and/or lack of jurisdiction
  • Represented technology company with electronic filing platform in case alleging antitrust and unfair trade practices claims, successfully defeating class certification using economic expert testimony and obtaining summary judgment for client
  • Represented technology company with electronic platform in case alleging violations of various state provisions related to filing fees, obtaining dismissal, which was upheld on appeal, and for which certiorari was denied by the Georgia Supreme Court
  • Represented commercial financier in class action alleging various claims arising from automatic insurance placed on leased office equipment, obtaining summary judgment after class certification
  • Obtained summary judgment for bank in case involving finance of satellite equipment on allegations of fraud and unfair/deceptive trade practices

  • Hired to try long-running case six weeks before jury trial for premium finance company and subsidiary of large insurer against claims of fraud and unsuitability, successfully limiting large claim to verdict of $29,000
  • Successfully appealed and obtained reversal of denial of summary judgment of shareholder and breach of fiduciary duty claims against large medical practice and select shareholders, successfully avoiding lengthy jury trial
  • Obtained a defense verdict in favor of premium financier and subsidiary of large insurer in claims of negligence after plaintiff suffered fire loss that was not covered because financier cancelled the policy for nonpayment of premiums by borrower/insured
  • Obtained a defense verdict in favor of developer after a two-week jury trial against claims by neighboring property owner that he was gifted the property by previous owner before she died, on which developer had built or was building multiple homes after purchasing the property from the estate
  • Obtained a large verdict in favor of asset management company against large commercial tenant after bench trial brought to enforce terms of settlement between parties
