Overview

Alexander Dudley is a Fort Lauderdale attorney in Holland & Knight's Litigation and Dispute Resolution Practice. Mr. Dudley has experience in all aspects of the litigation process, including electronic discovery and electronically stored information (ESI), class actions and trial preparation. Mr. Dudley represents clients in nationwide matters in state and federal courts.

Mr. Dudley focuses his national practice on managed care litigation and reimbursement disputes between providers and both private and governmental payers. He assists behavioral healthcare facilities, hospitals and health systems, physician groups, dental service organizations (DSOs), medical service organizations (MSOs), laboratories, pharmacies, home care providers, billing companies and other provider and provider-adjacent organizations to resolve reimbursement disputes, including through litigation and arbitration.

Mr. Dudley has significant experience representing companies in data privacy litigation and has defended numerous companies in high-stakes lawsuits and class actions arising from data breaches, a company's use of technology on company websites and other privacy issues. He also has experience litigating antitrust claims, including Section 1 and Section 2 claims under the Sherman Act, and has published several articles on antitrust issues.

Mr. Dudley's notable matters include:

  • obtaining a $2 million judgment following a bench trial on behalf of a medical receivable finance company based on breaches of representations and warranties in a purchase and sale contract
  • representing a surgical practice against a health insurance carrier in arbitration before the American Arbitration Association (AAA) for improper denials of medically necessary services
  • representing a behavioral health provider in a dispute and overturning a substantial overpayment demand from a health insurance carrier following an audit of historical claims
  • obtaining a Financial Industry Regulatory Authority (FINRA) arbitration award denying customer claims and recommending expungement of a former employee's disclosure, where a customer alleged that a financial institution breached fiduciary duty and violated suitability obligations
  • representing a Fortune 50 company in defending more than two dozen class actions arising from a data security incident and implicating novel claims under the federal Cable Communications Policy Act of 1984
  • representing audiology and vision networks in defense of a data breach class action brought on behalf of a nationwide class of more than 1 million individuals
  • obtaining a $159 million jury verdict for compensatory and punitive damages on behalf of a major cruise line against the manufacturer of essential vessel parts for claims of fraud and negligent misrepresentation
  • representing a former poultry renderer asserting antitrust claims under Section 1 and Section 2 of the Sherman Act based on an anti-competitive scheme to force the renderer out of the market
  • assisting a health system in a payer dispute involving systematic downcoding and denials of high-acuity evaluation and management services
  • assisting a national pharmacy network resist unsubstantiated termination for cause by a pharmacy benefit manager, resulting in withdrawal of the termination
  • representing a hospital system in the defense of a class action alleging state and federal wiretap violations related to alleged use of tracking technologies on the company's website
  • prevailing on summary judgment on claims for violations of the Florida Deceptive and Unfair Trade Practices Act (FDUTPA) on behalf of a national property and casualty insurance company in a dispute arising from the healthcare provider's submissions of fraudulent charges arising from predetermined, medically unnecessary and unlawfully rendered treatment

Mr. Dudley also maintains an active pro bono practice, which ranges from assisting military veterans to representing domestic violence and stalking victims. Notably, he helped secure a favorable settlement for a military veteran in a litigation brought against a roofing company.

While in law school, Mr. Dudley served as an articles and comments editor for the University of Miami Law Review. He also worked as a Dean's Fellow for Professor Shakira Pleasant's Legal Communication and Research class, as well as a research assistant to Professor Caroline Bettinger-Lopez on projects related to human rights.
