Overview

Brent Gary, a litigation attorney in Holland & Knight's Tysons office, focuses his practice on commercial litigation, with particular experience in the representation of entities in commercial and government contracting disputes.

In addition, Mr. Gary has extensive experience in civil litigation in federal and state courts involving product liability and business litigation, financial services matters, construction-related issues, real property disputes, eminent domain issues, representation of policyholders in insurance coverage disputes and commercial-related disputes involving fraud.

Prior to joining Holland & Knight, Mr. Gary was an attorney at a global law firm in its Tysons office.

Representative Experience

  • Obtained a significant arbitration award involving a complex dispute between joint venture partners over the costs for a multi-faceted mixed-use commercial real estate development in Northern Virginia
  • Successfully defended a large government contractor in several matters against entities with whom it entered into contracts for construction-related work and services provided to military bases in several foreign countries
  • Represented a policyholder in an insurance coverage dispute, which resulted in a significant jury verdict for the policyholder regarding the use and development of valuable real property in Northern Virginia
  • Litigated a complex condemnation matter in the City of Alexandria, Virginia, involving the taking of certain commercial property located in a prominent and highly visible area of the city
  • Litigated and resolved multiple eminent domain cases involving the taking of valuable commercial real property in various jurisdictions within Northern Virginia
  • Defended a high-profile entity in a complex landlord/tenant contract dispute involving a well-publicized construction project along Interstate 395 outside of Washington, D.C.; obtained a dismissal of the case in the early stages of the litigation and successfully opposed a Petition for Appeal with the Virginia Supreme Court
  • Represented a prominent real estate developer in a hotly contested commercial real estate tax appeal and obtained a favorable result for the client; the property at issue is a complex property with more than 150 leases and ground leases
  • Represented property owners and landlords in Virginia and Maryland regarding a complex commercial lease dispute involving various contractual provisions as to construction build-out obligations, lease terms, use and location of utilities and premises operation requirements
  • Resolved a hotly contested commercial lease dispute between a landlord and a tenant restaurant chain
  • Successfully resolved a landlord/tenant lease dispute involving the payment of common area maintenance (CAM) charges associated with a medical facility in Fairfax County, Virginia
  • Acquired dismissals of two suits in the early stages of litigation that involved and attempted to set aside a foreclosure sale and monetary judgment in connection with the purchase of commercial real estate in Fredericksburg, Virginia
  • Efficiently resolved a complicated real estate-related restrictive covenant dispute on behalf of a prominent national restaurant chain
  • Litigated a multifaceted construction dispute regarding complex mechanic's lien issues in connection with the construction of a premier golf course
  • Defended and obtained a successful resolution of a dispute in a breach of contract action involving the construction of a shopping center and interchange in Northern Virginia
  • Successfully defended a mechanic's lien dispute involving a significant residential construction job in Northern Virginia
