Overview

Damián A. Gómez Corona is a labor, employment and benefits lawyer in Holland & Knight's Mexico City office. Mr. Gómez focuses his practice on providing high-quality labor consulting and litigation services to national and transnational employers in Mexico.

Mr. Gómez provides advice to employers in regard to their day-to-day operations, such as with offer letters, employee onboarding, employment agreements, amended agreements, termination documents, employment policies, benefits, mandatory profit-sharing, golden parachutes, stock option plans, and non-compete and non-disclosure agreements. He also is actively involved in counseling employers in the planning and execution in the termination of high-level employees.

In addition, Mr. Gómez has a significant in-depth knowledge and experience providing legal counsel to corporate groups and companies in relation to their labor-corporate structure to comply with outsourcing and insourcing laws and regulations. He also dedicates part of his practice offering advice to buyers, sellers and investors in mergers and acquisitions (M&A) operations from a labor perspective. Mr. Gómez has participated in several relevant international and national transactions in Mexico, while coordinating with foreign counsels.

Mr. Gómez participates in collective employment matters, including negotiation with unions, collective bargaining agreements, strikes and work stoppages. He is well versed in the Rapid Response Mechanism established in Annex 31-A and 31-B of the United States-Mexico-Canada Agreement (USMCA) that is triggered due to alleged denial of association or collective bargaining rights.

Lastly, Mr. Gómez has experience in social security issues, in particular related to the mandatory social security regime established for employers, including work hazards, professional illnesses, leave of absence and maternity leave, among others.

Prior to joining Holland & Knight, Mr. Gómez worked in the labor practice of several renowned Mexican law firms.
