Overview

Quynh-Anh Kibler is an attorney in Holland & Knight's Nashville office and a member of the Construction Industry Practice. Ms. Kibler assists clients in the construction industry, such as commercial real estate owners, developers, lenders, contractors and subcontractors, as well as other related industries with large construction projects.

Ms. Kibler is experienced in handling disputes involving a variety of construction-related and insurance-related claims. On the transactional side, she frequently prepares different types of construction agreements, reviews construction agreements revised or prepared by others, advises clients on potential risks and exposures, and negotiates and tailors contract terms based on the unique needs and risk tolerance of each individual client. She also assists clients in reviewing and analyzing their commercial insurance policies.

In addition to her construction practice, Ms. Kibler's experience encompasses commercial disputes involving contracts, business torts, real property interests, shareholder interests, local governments, administrative proceedings and data privacy.

Previously, Ms. Kibler clerked for the Honorable W. Neal McBrayer in the Tennessee Court of Appeals, Middle Section, and for the Honorable J. Steven Stafford in the Tennessee Court of Appeals, Western Section.

Representative Experience

  • Represented a national healthcare company against a solar contractor, serving as second chair and successfully obtaining a $6 million arbitration award based on the contractor's misrepresentation and defective work on projects at different facilities across the U.S.
  • Represented a global construction company against a subcontractor, successfully obtaining confirmation of a $3.7 million arbitration award based on the subcontractor's breach of an agreement relating to a design-build project for a federal agency located in a U.S. territory
  • Represented a construction lender, successfully obtaining early dismissal of a lawsuit filed by a guarantor alleging claims for unjust enrichment, fraudulent misrepresentation, violation of the Tennessee Consumer Protection Act (TCPA) and violation of the Fair Debt Collection Practices Act (FDCPA)
  • Represented a residential master developer against a homebuilder, obtaining a favorable resolution for the client
  • Represented a homeowner against a contractor for the improper installation of spray foam insulation, obtaining a favorable resolution for the client
  • Represented a chicken farm owner in responding to a material lien claimant, obtaining a favorable resolution for the client
  • Drafted and negotiated design and construction vendor agreements for a national hotel chain's projects at its properties across the U.S.
  • Drafted and negotiated various construction agreements for owners, contractors and subcontractors

  • Represented a solar company, successfully defending against a challenge to the company's permit allowing the company to operate a solar farm
  • Represented a local bar against a historic zoning commission for additions made on the property, obtaining a favorable resolution regarding alleged violations of the commission's guidelines

  • Represented a popular entertainment and media company, successfully obtaining an early dismissal of a copyright lawsuit alleging that the company's popular movies contained elements that infringed on a book for which the plaintiff allegedly held a copyright
  • Represented a widely known American clothing brand, successfully obtaining a third-party subpoena to retrieve evidence located in the U.S. to be used in connection with foreign trademark proceedings to protect the company's brand
  • Represented a media company, successfully assisting in the dismissal of the company from a defamation lawsuit arising out of an article reporting on election fraud
  • Represented a media company, successfully obtaining early dismissal of a lawsuit alleging claims for invasion of privacy, intentional infliction of emotional distress, assault, conversion, misappropriation under the Uniform Trade Secrets Act (UTSA), violation of Title VII of the Civil Rights Act of 1964, and violation of the Sherman Act
  • Represented journalists who submitted a public records request for records relating to the death of a famous singer, successfully obtaining dismissal of the case and access to the records
  • Represented a television personality who offered a reward for information leading to arrest and conviction of a wanted criminal, successfully arguing for and obtaining an early dismissal of a lawsuit alleging that the plaintiff was entitled to that reward where the condition of the reward was not fulfilled

  • Represented a finance company, successfully obtaining early dismissal of a lawsuit alleging claims for breach of contract, violation of the Tennessee Consumer Protection Act and wrongful foreclosure, among other things
  • Represented a finance company, successfully obtaining early dismissal of the company from a lawsuit alleging that the company conspired with one of its long-standing clients to defraud another of its clients with respect to the financing of a farm

  • Successfully represented a former employee of a company for claims related to the company's refusal to pay promised commissions owed and firing the employee under a pretext, serving as second chair at a jury trial and primary brief writer on appeal
  • Represented company in a contract dispute, successfully obtaining affirmance of motion to dismiss based on a forum selection clause
  • Assisted with several appellate briefs and answers before the Tennessee Court of Appeals, the Tennessee Supreme Court and the U.S. Court of Appeals for the Sixth Circuit

  • Represented a distributor of luxury electrical equipment, successfully obtaining a third-party subpoena to retrieve evidence located in the U.S. to be used in connection with a business dispute against the manufacturer in a foreign tribunal
  • Represented a trucking company, successfully obtaining summary judgment in the company's favor against an insurance company for insurance coverage of a building destroyed by a tornado
  • Represented a government services company, successfully arguing for and obtaining early dismissal of the company from a lawsuit alleging wrongful withholding of treatment from a patient and other wrongful actions that ultimately led to the patient's death
  • Represented a popular custom clothing company, successfully obtaining a stay of the second-filed case while the first-filed case is litigated in company's chosen forum
  • Represented an oil and gas company in a lawsuit filed by an environmental group seeking disclosure of confidential provisions located in the company's contract with a governmental agency, successfully obtaining summary judgment in the company's favor
  • Represented servicer of factoring agreements, successfully obtaining early dismissal of lawsuit filed by purchaser of an account debtor's accounts receivables alleging claims against servicer for breach of contract, promissory estoppel, and procurement of breach of contract when account debtor failed to pay
