Overview
Joshua Kirschner is an attorney in Holland & Knight's Atlanta office and a member of the Public Policy & Regulation Group. Mr. Kirschner focuses his practice on advising gaming clients on litigation, regulatory and strategic risk in connection with various gaming operations, business transactions and disputes, and crisis management and response.
Mr. Kirschner has worked on gaming-related matters for a wide variety of clients within and adjacent to the gaming industry, including sports betting, iGaming, fantasy sports, casino and skill‑based gaming companies, as well as prediction market platforms, sports teams and leagues, media and entertainment companies, technology companies and financial service providers. He provides guidance to clients launching new gaming products, advocating for legislative and regulatory innovation, defending operators in litigation and against government investigations, and supporting mergers, growth strategies and intellectual property licensing.
Drawing on both former in‑house and law firm experience, he advises operators, vendors and entrepreneurs on navigating complex state, federal and Tribal regulatory landscapes. Mr. Kirschner's experience also includes crisis management, payment and ancillary services, licensing, compliance, internal investigations and strategic expansion for businesses in highly regulated industries.
As former lead in‑house counsel and head of government affairs for a leading sports gaming company, Mr. Kirschner brings a blend of inside knowledge and outside perspective. He regularly assists gaming clients with regulatory compliance, licensure, licensing applications, state-by-state policy planning and navigating responsible gaming obligations. He also advises on business transactions, partnerships, marketing and payment processor relationships.
In the white collar and government investigations arena, Mr. Kirschner represents businesses and individuals in internal investigations and high‑stakes regulatory or criminal matters, including grand jury or informal agency inquiries. He works across industries to manage risk, reputational exposure, and civil or criminal enforcement. His experience includes government relations, litigation, testimony preparation and proactive compliance counseling.
Mr. Kirschner also brings experience in broader government and regulatory affairs – from developing strategy for proposed legislation to drafting ballot questions, advising on federal and state policy initiatives and supporting engagements with regulators and policymakers.
In addition to his legal practice, Mr. Kirschner authors commentary and speaks regularly on gaming, regulatory developments and government investigations and litigation. Recent pieces include analyses of sports betting excise taxes and evolving Tribal/mobile gaming frameworks.
Prior to joining Holland & Knight, Mr. Kirschner was an attorney at an AmLaw 100 law firm in its Atlanta office. While in law school, he served as a legislative extern in the office of Sen. Johnny Isakson (R-Ga.) and as a teacher's assistant for mergers and acquisitions law.

- Represented a daily fantasy sports operator in multi-jurisdiction litigation
- Advised clients on payment processor relationships, on‑ramp financial regulations and responsible gaming compliance
- Secured dismissal of a major sports betting operator's lawsuit involving alleged fraudulent account withdrawals
- Represented an elected official as part of a wide-ranging probe of various corruption and inappropriate conduct allegations
- Assisted in multiple municipal and county-level internal investigations
