Overview

John Nix is a litigation attorney in Holland & Knight's Nashville office. Mr. Nix helps clients navigate a range of complex issues, including intellectual property (IP) and data privacy-related matters.

Mr. Nix handles complex trademark, trade dress, cybersquatting, domain name, copyright and trade secret disputes, with a primary focus on federal and state court litigation and enforcement. He works closely with clients to pursue and develop modern, no-nonsense approaches to IP rights enforcement. He regularly represents clients in inter partes and ex parte proceedings before the Trademark Trial and Appeal Board (TTAB) of the U.S. Patent and Trademark Office (USPTO), as well as in Uniform Domain-Name Dispute-Resolution Policy (UDRP) arbitrations before the World Intellectual Property Organization (WIPO) and National Arbitration Forum.

Mr. Nix also has significant experience in data privacy litigation, helping to defend companies in high-stakes class action lawsuits arising from cyber incidents.

In addition, Mr. Nix supports clients with trademark and copyright clearance through prosecution in the U.S. and abroad, aiding in the maintenance and management of global IP portfolios. To this end, he regularly advises clients on developing global brand, content and product protection strategies.

Mr. Nix represents clients across all industries, including fashion and luxury goods, food and beverage, software, electronics, telecommunications, consumer products, sports, music and entertainment, among others. As a committee member of the International Trademark Association, Mr. Nix stays up to date on cutting-edge issues involving trademark law.

During law school, Mr. Nix was a dedicated member of the moot court program, competing in four major competitions during his tenure, and he continues his dedication to the program by serving as an alumni coach and judge.

  • Represented a major e-commerce company in obtaining a preliminary injunction against more than 40 defendants for trademark infringement and related cybersquatting activities
  • Defended an addiction treatment center against claims for federal trademark infringement, false designation of origin, unfair competition and trademark dilution, along with claims for state trademark infringement, trademark dilution, false advertising and unfair competition
  • Represented a fashion designer in federal court to enforce trademark rights against a content creator
  • Represented a leading games, intellectual property (IP) and toy company in enforcing judgment against a foreign company and its alter ego related to licensing royalties
  • Represented a Fortune 20 company in enforcing trademark rights through proceedings before the Trademark Trial and Appeal Board (TTAB)
  • Represented a video game company in proceedings before the TTAB, which resulted in the cancellation of a third-party trademark registration
  • Represented a proprietary futures trading company in proceedings before the TTAB, which resulted in the cancellation of a third-party trademark registration
  • Represented a national winery in proceedings before the TTAB, which resulted in the cancellation of a third-party trademark registration
  • Represented a publicly traded retail company in proceedings before the TTAB, which resulted in the abandonment of a third-party trademark application
  • Represented a global apparel company in proceedings before the TTAB, which resulted in favorable amendments to a third-party trademark application
  • Represented a global apparel company in proceedings before the TTAB, which resulted in the cancellation of a third-party trademark registration
  • Represented a product labeling company in proceedings before the TTAB, which resulted in the cancellation of a third-party trademark registration
  • Represented a social network provider in consolidated proceedings before the TTAB involving a third party's service mark registration and application
  • Represented a media company in global trademark proceedings, which involved managing foreign counsel efforts
  • Represented a financial company in defending a third party's cancellation proceeding before the TTAB

  • Represented an information technology (IT) management software and technology provider in seeking and obtaining early dismissal of a putative class action alleging claims related to a cyber incident experienced by one of the company's clients
  • Represented a global media and technology company in a putative class action alleging claims related to a cyber incident
