Overview
Madeline Schonberger is a litigation attorney in Holland & Knight's Philadelphia office. Ms. Schonberger's practice focuses on international trade litigation and enforcement. She represents clients in high-stakes trade and customs disputes, including matters involving tariffs, import compliance, customs enforcement and challenges to federal trade actions. Her broader litigation experience also includes regulatory investigations, data privacy class actions, employment discrimination matters and other complex commercial disputes.
International Trade: Ms. Schonberger advises importers and other companies on customs and trade matters at the intersection of litigation, enforcement and regulatory compliance. She counsels clients on tariff exposure and mitigation, customs compliance, import-related investigations and enforcement actions, and issues arising from rapidly changing U.S. trade policy.
Tariffs and Sanctions: Ms. Schonberger represents and advises clients regarding International Emergency Economic Powers Act (IEEPA) tariff litigation and refund strategies, including navigating the legal and practical consequences of federal court decisions affecting tariff liability and recovery of duties paid to U.S. Customs and Border Protection (CBP). Her practice includes helping companies assess potential customs and trade enforcement risk, respond to government inquiries and develop strategies for addressing potential compliance issues before they escalate into enforcement proceedings or litigation.
Finance and Digital Assets: Additionally, Ms. Schonberger advises financial institutions and emerging companies on Bank Secrecy Act/anti-money laundering (BSA/AML) regulatory compliance, including issues involving money transmission, digital assets and cryptocurrency, and compliance with the Guiding and Establishing National Innovation for U.S. Stablecoins Act (GENIUS Act).
Food, Health and Wellness: Ms. Schonberger also advises clients in the food, health and wellness space on issues involving Federal Trade Commission (FTC) and U.S. Food and Drug Administration (FDA) compliance, false advertising claims, and the substantiation of marketing and advertising representations.
While in law school, Ms. Schonberger gained valuable appellate experience externing for the Honorable Daniel McCaffery of the Pennsylvania Superior Court. She also interned with the U.S. Department of Justice in Washington, D.C.
