Impact of First Impression Equitable Relief ERISA Ruling

ERISA litigation attorneys Todd Wozniak and Cory Thomas co-authored an article published in Bloomberg Law examining a recent Eleventh Circuit ruling finding that beneficiaries of ERISA-governed plans now have a cause of action for equitable relief when an employer breaches its fiduciary duty while administering an employee benefit plan. The authors say employers should immediately audit their human resources documentation and processes to avoid similar lawsuits.
