A Look at Health Care Providers' Workplace Safety Duties
Healthcare attorneys Victor Moldovan and Dan Silverboard co-authored an article for Law360 examining state and federal laws governing healthcare providers' duty to provide a safe environment for employees, patients and visitors. This duty now encompasses addressing workplace violence, which raises questions about what exactly the duty to prevent violence entails and how an organization can meet that duty while still offering supportive healthcare services. In the article, Mr. Moldovan and Mr. Silverboard break down federal and state regulations, from the Occupational Safety and Health Act and Occupational Safety and Health Administration (OSHA) enforcement to Georgia's Safer Hospitals Act. They also analyze questions providers should keep in mind when developing policies and procedures to address workplace safety.
