Federal Court Finds Project Labor Agreement Mandate Unlawful
Government Contracts attorneys Jeremy Burkhart and Bailey McHale wrote an article featured in Pratt's Government Contracting Law Report examining a ruling by the U.S. Court of Federal Claims. The decision declared President Joe Biden's requirement for project labor agreements (PLAs) on federal construction projects valued at $35 million or more to be unlawful. In the article, Mr. Burkhart and Ms. McHale explore the long-standing debate over PLAs – collective bargaining agreements between contractors and unions for specific projects – which has been addressed by executive orders for several decades, including Biden's Executive Order 14063 mandating that contractors and subcontractors working on large federal construction projects enter into a project labor agreement.
