A federal judge sided with the U.S. Department of Justice's Antitrust Division and agreed to effectively block Aetna Inc.'s $37 billion deal to buy rival insurer Humana Inc. Attorney David Kully, a former head of the litigation section within the U.S. Department of Justice's Antitrust Division, weighed in on the possibility of a successful appeal.
"Aetna would have to establish that the court's factual findings were clearly erroneous, which would make succeeding on appeal a big challenge," said Mr. Kully.
