Benefits Litigation To Watch For Post-Pandemic

Partner Todd Wozniak was interviewed for a Law360 article describing the types of benefits-related litigation employers can expect once the COVID-19 pandemic peters out. Mr. Wozniak, who leads Holland & Knight's ERISA, ESOP and Employee Benefits Litigation Team, commented on notices about healthcare coverage for furloughed workers, retirement plan investments, Employee Stock Ownership Plans (ESOP) and denied insurance claims.

"I see more litigation over health care coverage decisions — either insurers or third-party administrators denying claims for certain kinds of treatment, or mishandling treatment related to the COVID-19 virus," he said, adding that such lawsuits may extend into disability claims.
