TikTok Is The Tip Of The Iceberg For CFIUS' Data Concerns
International Trade Partner Antonia Tzinova was quoted in a Law360 article about whether the Committee on Foreign Investment in the United States (CFIUS) will compel China's ByteDance Ltd. to sell TikTok to a U.S. buyer like Microsoft. The primary issue at hand is the vast trove of personal data collected by the app. There are concerns from officials over how the Chinese government might look to exploit that sensitive U.S. user information. Because a foreign entity has control over a company with sensitive personal information about U.S. citizens, CFIUS has jurisdiction to recommend a divestiture to the president, who can then require that a deal take place
"CFIUS initiating this review was not the end of the story," said Ms. Tzinova. "There was a massive government undertaking, with bipartisan support, and honest concerns."
