The EB-5 Immigrant Investor Program is Making a Comeback. Here's What it Means for Local Developers

Public Policy & Regulation Partner Ron Klein was quoted in a South Florida Business Journal article discussing the return of the EB-5 Immigrant Investor Program. The EB-5 program enables immigrant investors to obtain U.S. residency if they help fund real estate projects that create at least 10 jobs in the United States. Regional centers, which facilitate these transactions, could back real estate projects or other business ventures with EB-5 investments until June 2021, when the program lapsed. On March 10, the United States Senate passed H.R.2471, which included provisions to reactivate the defunct EB-5 regional center program. The new bill includes changes to the programs expiration date and updates the minimum investment amounts. Mr. Klein commented that the new legislation also includes language that will help prevent "bad actors" from taking advantage of the program.

"In the whole history of EB-5, most [regional center] projects have been very successful."
