DOJ Likely to Impose Guilty Plea on Boeing for DPA Violations, Lawyers Say

Litigation attorney Barbara Martinez was mentioned in a Global Investigations Review article about the potential consequences Boeing faces for breaching its 2021 deferred prosecution agreement (DPA) with the U.S. Department of Justice (DOJ). The article discussed the likelihood of the DOJ imposing a guilty plea on Boeing, as well as the company's options for renegotiating the settlement. Ms. Martinez, who is a former prosecutor in the DOJ's Criminal Fraud Section, described the extent of a renegotiation in the event of a DPA breach.
"Whatever was originally agreed to as to penalties, fees, fines – even the provisions related to other things, like compliance – are going to be re-addressed," she said, adding that if Boeing cannot convince the DOJ that it did not breach the agreement, the company will have to "up the ante" in terms of fines and other concessions.
