Can a Landlord Ban Pets from Its Residential Building?
Real Estate attorney Estéban García was interviewed by Asuntos Legales about the regulation of pets in residential buildings in Colombia. Mr. García explained that various court decisions and laws have established that condominiums and other properties cannot prohibit the entry or possession of domestic animals, but they can regulate their activities, such as through requiring leashes, to help maintain healthy living conditions. On the other hand, he added, for horizontal properties that are not used for living – commercial, industrial or health centers – such a ban is valid.
"In these cases it would be valid to ban owning, transporting or keeping pets in joint properties whose purpose is affected by the presence of animals. For example, in horizontal properties for industrial use or health services, it is clear that the ban would not only be valid but also necessary," he said.
