Top Gov't Contracts Cases to Watch in the 2nd Half of 2025

Government Contracts attorney Jeremy Burkhart was mentioned in a Law360 article previewing significant federal court cases affecting government contractors on the docket for the remainder of 2025. The article talked about upcoming U.S. Supreme Court cases regarding contractor immunity as well as federal appellate cases on who qualifies as an interested party for purposes of challenging a contracting agency decision as well as the procedures for agency actions during bid protests. Mr. Burkhart commented a case before the U.S. Court of Appeals for the Eleventh Circuit evaluating a Florida district court decision that a provision in the False Claims Act (FCA) allowing whistleblowers to bring lawsuits on the government's behalf is unconstitutional. Mr. Burkhart characterized the Eleventh Circuit's ruling as "very consequential," given that most FCA cases are brought by whistleblowers and the government thus has a vested interest in maintaining the qui tam provision allowing whistleblower actions.
