Scope of Trump's Next Tariffs Loom as Key to Legal Challenges

International Trade attorney Patrick Childress was quoted in a Bloomberg Law article examining how the scope of the Trump Administration's anticipated Section 301 tariffs could affect their vulnerability to legal challenges. The article reported companies and industry groups are calling for a more targeted approach as the administration looks to replace tariffs previously struck down by the U.S. Supreme Court, warning that broader measures could strengthen claims that the government is overreaching or attempting to recreate prior duties under a different (but still nonviable) legal framework. Mr. Childress explained that the administration may seek to distinguish the new tariffs from the earlier regime as a method of proactive defense against potential lawsuits.

"USTR may feel compelled – perhaps as a way to shore up its legal position in anticipation of future litigation – to create some daylight between the old IEEPA tariffs and the new Section 301 tariffs," he added.
