Privacy Enters the AI Era with Regulation That Begs to Be Updated

Data privacy attorney Anna Catalina Pérez was cited in an article published by Revista Dinero as part of its special lawyers edition that addresses the future of data privacy law in Colombia. Law 1581 of 2012 forms the spine of regulations in the country, with the Superintendency of Industry and Commerce (SIC) as its enforcement authority, but the arrival of artificial intelligence (AI) technologies and legislative initiatives to align the country closer to the European Union's General Data Protection Regulation (GDPR) have generated debate about updating these laws. Anna Catalina identified areas not covered by current rules that should be considered among efforts to modernize Colombia's regulatory framework.

"The most relevant gaps are in automated decisions, algorithmic profiling and mechanisms for auditing AI systems that process personal information," she said.
